Technology, courts and access to justice: A transformative journey

Abstract

The unprecedented growth of digital technology has fundamentally redefined judicial systems worldwide, transforming both the administration of courts and the manner in which individuals engage with the justice delivery process. This article explores the dynamic interplay between technology, courts, and access to justice, focusing on the ongoing digital transformation of judicial institutions. The integration of Information and Communication Technology (ICT) into the judicial framework has facilitated the emergence of e-courts, virtual hearings, electronic filing platforms, digital case management systems, and online dispute resolution mechanisms. These technological innovations have modernized court administration by enhancing operational efficiency, strengthening transparency, and improving the accessibility of legal services. Moreover, they have significantly reduced procedural complexities, administrative bottlenecks, and delays that have long hindered the effective and timely dispensation of justice.

The article further analyzes the accelerated digital transformation of courts in the aftermath of the COVID-19 pandemic, which underscored the necessity of resilient and technology-enabled justice systems. While digitalization has expanded opportunities for timely and cost-effective dispute resolution, it has also introduced complex challenges relating to digital exclusion, cyber security, data protection, technological literacy, and infrastructural limitations. Therefore, the success of judicial digitalization depends upon inclusive policies, robust technological infrastructure, and continuous capacity-building initiatives. The article concludes that technology is not merely a tool for modernizing courts but a transformative force capable of redefining access to justice. By balancing innovation with inclusivity and safeguarding fundamental rights, judicial systems can harness technology to build a more efficient, transparent, and citizen-centric framework for the administration of justice.
